Cancelling Your Tax Credit Claim. Again .... 18 June 2009 Once again, we are hearing from very frustrated people who want to cancel their Tax Credit claim for the coming tax year. There are many different reasons for this, but it's usually something to do with HMRC's bullying, mistakes, incompetence, evasion of the truth, 'financial rape' of overpaid claimants and systematic maladministration of Tax Credits. If you didn't claim Tax Credits for 2008/09 (April 2008 to April 2009), thought you were already out of the Tax Credit system but have received an Annual Review and Renewal Pack and don’t want to claim for 2009/10 you may like to use our updated cancellation letter template (just edit to suit). However, if you were paid Tax Credits for 2008/09 and want to stop claiming for 2009/10, (April 2009 to April 2010), you DO need to complete the Annual Review (just not the Renewal Pack). VERY IMPORTANT: If you did receive Tax Credits for 2008/09 and don’t complete and return the Annual Review by 31st July 2009, HMRC may terminate your 2009/10 award and any provisional payments made so far will become an overpayment. So please do return the Annual Review! ALSO VERY IMPORTANT: If you have received any payments between 6th April 2009 and now, these are provisional payments. HMRC pay these until they receive your Annual Review, and then adjust your future payments accordingly. If you cancel your award immediately, all of these provisional payments will become an overpayment. We have included a paragraph in the updated cancellation letter which should ensure that HMRC allows for this. But, obviously, TCC can take no responsibility for HMRC's actions if an overpayment is generated by the Tax Credit Office. Déjà Vu? Did you send our template cancellation letter or a similar letter last year, telling HMRC you don’t want to claim, but still received a Renewal Pack this year?
